These terms are an agreement between you and Legacy Bits LLC (“we”, “us”), which operates Don’t Budget. They cover the Don’t Budget apps and dontbudget.com (together, the “Service”). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle your information.
1. Who can use Don’t Budget
You must be at least 18 years old and able to form a binding contract. The Service is offered in the United States. You are responsible for the accuracy of what you enter and for everything done under your account.
2. What the Service is, and is not
Don’t Budget helps a household keep money in envelopes, log purchases and match them to bank transactions. It is a record-keeping tool. We are not a bank, we do not hold or move your money, and balances in the app are records you and your team keep, which can differ from what is in your bank accounts. Nothing in the Service is financial, investment, tax or legal advice. Decisions about your money are yours.
3. Accounts and household teams
- Keep your sign-in email secure. Tell us promptly at support@dontbudget.com if you think your account was used without your permission.
- A team is shared: every member can see its budgets, purchases and connected bank transactions. Owners manage membership, bank connections and settings, and can delete the team and all of its data for every member.
- Only invite people you want to share your household’s finances with. You are responsible for who you invite.
4. Bank connections
Bank connections are provided by Plaid Inc. By connecting an account, you authorize us and Plaid to access information from your financial institution on your behalf, as described in our Privacy Policy, and you agree to Plaid’s terms, including the Plaid End User Privacy Policy. Bank data comes from your institution and Plaid; it can be delayed, incomplete or wrong, and a connection can stop working until you reconnect it. We are not responsible for the accuracy of data provided by third parties. Only connect accounts you are authorized to access.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to store information you have no right to;
- access another person’s account or team, or data you are not authorized to see;
- interfere with, overload, probe or reverse engineer the Service, except where the law allows it;
- use automated means to access the Service, or resell it, without our written permission.
6. Fees
If we introduce paid features, we will tell you the price and terms before you are charged, and you will not be charged without agreeing to them.
7. Your content and our property
The information you and your team enter stays yours. You give us permission to store, process and display it as needed to provide the Service to you and your team. The Service itself, including its software, design and the Don’t Budget name, belongs to us and is protected by law. If you send us feedback, we may use it without owing you anything.
8. Changes, suspension and ending
We may change or discontinue features. We may suspend or end your access if you break these terms or if needed to protect the Service or other users. You can stop using the Service at any time and delete your account in the app, under Settings; a team owner can delete a team there too. If we shut the Service down, we will give reasonable notice when we can.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT BALANCES, MATCHES OR BANK DATA WILL BE ACCURATE.
10. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, LEGACY BITS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, OVERDRAFTS, LATE FEES OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US $100. Some jurisdictions do not allow these limits, so they may not all apply to you.
11. Indemnity
You agree to defend and hold us harmless from claims by third parties arising from your misuse of the Service or your breach of these terms.
12. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Florida, and you and we consent to their jurisdiction. Before filing a claim, please contact us at support@dontbudget.com so we can try to resolve it.
13. Apple App Store
If you downloaded the app from Apple’s App Store, these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app, including product liability, legal compliance or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You must comply with the App Store’s terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms. We will change the date at the top of this page and, for material changes, tell you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated terms.
15. General
These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
